These Terms & Conditions apply to the Tropical Fjord website and the current pre-launch VIP registration program operated by:

1. Acceptance

By using this website or completing a VIP registration, you agree to these Terms & Conditions. You must be at least 18 years old or have the legal authority to enter into this agreement.

2. VIP Registration

The USD 1 VIP registration payment provides priority access to the future Founding Guest offer and eligibility for one-time pre-launch pricing when the official campaign opens.

The VIP registration is not:

  • An accommodation booking or reservation.

  • A voucher for a specific stay.

  • A guarantee of a specific accommodation, travel date, exact discount or availability.

  • An investment, donation, ownership interest or financial security.

Any future accommodation purchase or booking will be subject to separate terms presented before payment.

 

3. Payment

The VIP registration requires a one-time payment of USD 1. Payments are processed securely through Stripe.

There are no recurring charges or automatic subscriptions.

 

4. Refunds

The USD 1 VIP registration payment is fully refundable until the official Founding Guest campaign opens for purchases.

To request a refund, email hello@tropicalfjord.com with the subject line Reservation Refund Request and include the name and email address used for registration.

Approved refunds will be returned to the original payment method. After the official booking period begins, the registration payment is non-refundable except where required by applicable law.

 

5. Project Status

Tropical Fjord Lodges is currently under development in Playa Cacao, Golfito, Costa Rica.

The project site is already owned, and restoration of the existing buildings and cacao plantation is underway. Final accommodation designs, materials, amenities, opening dates and campaign details may still be refined. We will provide updated information before customers are asked to purchase an accommodation package or make a booking.

 

6. Communications

We may send you messages required to manage your registration, payment, refund request and access to the pre-launch program.

Marketing communications will only be sent where permitted by applicable law. You may unsubscribe from marketing emails at any time.

 

7. Website Content

All website content, including text, photographs, graphics, logos and designs, is owned by or licensed to HOF EST, LLC unless otherwise stated.

You may not reproduce or use this content commercially without prior written permission.

 

8. Liability

We do not guarantee that the website will always be available or free from technical errors.

To the maximum extent permitted by law, HOF EST, LLC is not liable for indirect or consequential losses arising from the use of the website or participation in the VIP program.

Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded.

 

9. Applicable Law

These Terms are governed by the laws of the State of Delaware, United States.

This choice of law does not remove any mandatory consumer rights that apply to you under the laws of your country of residence.

 

10. Changes

We may update these Terms when the website or pre-launch program changes. The version in effect when you register will apply to your registration unless a change is required by law or is more favorable to you.
